Father Retains Joint Physical Custody At Trial

Yesterday, Molly Rosenblum tried a divorce and custody matter before Judge Harter in the Eighth Judicial Court, Family Division. The case, Valencia v. Gonzalez, had been hotly contested for several months. The parties had a very short term marriage but had one minor child. Natural mother was insisting that father only receive visitation on Sundays with his daughter. Father wanted joint custody of his daughter.

When the parties appeared before the judge, natural mother conceded that father could have joint physical custody, but the parties could not agree on father's days for visitation or a child support amount. The parties testified before the judge and the matter was decided by Judge Harter in father's favor. He received joint physical custody of his daughter and was awarded the deviations he was requesting in child support for his four other children.
